1. The Service

Focalyn provides an AI-powered local business prospecting tool. The Service discovers publicly available business data from Google Maps and other public sources, enriches it with AI-generated intelligence, and presents it to you in a structured format for legitimate sales and marketing use.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of a company, you represent that you have the authority to bind that company to these Terms.

3. Acceptable Use

You agree to use Focalyn only for lawful purposes. You must not: use the Service to send unsolicited bulk email (spam); violate applicable anti-spam laws (GDPR, CAN-SPAM, CASL); harass, abuse, or harm individuals; attempt to circumvent rate limits or access controls; resell or redistribute data obtained through the Service without authorisation; use automated tools to scrape or harvest data from Focalyn itself.

4. Your Responsibility for Outreach

Focalyn provides contact data for business-to-business prospecting. You are solely responsible for how you use this data in your outreach. You must comply with all applicable laws in your jurisdiction. Focalyn is not responsible for any legal consequences arising from your outreach activities.

5. Subscriptions and Billing

Focalyn offers subscription plans billed monthly or annually via Stripe. Your subscription renews automatically until cancelled. You may cancel at any time through your account settings. No refunds are provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.

6. Free Trial

New accounts receive a 14-day free trial with access to the Starter plan features. No credit card is required to start a trial. At the end of the trial, access is limited unless you subscribe to a paid plan.

7. Data and Intellectual Property

You retain ownership of any data you input into the Service. The lead data discovered and enriched by Focalyn is provided for your use within the bounds of these Terms. Focalyn retains all rights to its software, algorithms, and AI models. You may not reverse-engineer, copy, or redistribute the Service.

8. Availability and Uptime

We strive to keep Focalyn available at all times but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, infrastructure issues, or events outside our control. We are not liable for any losses resulting from downtime.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in abusive behaviour. You may terminate your account at any time from your account settings. Upon termination, your data will be deleted within 30 days.

10. Limitation of Liability

To the maximum extent permitted by law, Focalyn is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of the data provided. AI-generated insights are provided for informational purposes and should be verified before acting on them.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the application. Continued use of the Service after the effective date of changes constitutes acceptance.
